Warranty.

Warranty Statement: Standard Manufacturer’s Warranty.

 

In addition to the rights set out in these terms and conditions, the end customer is entitled to statutory rights in the event of defects, which may be exercised free of charge and are not restricted by these terms and conditions.

Karasto Armaturenfabrik Oehler GmbH (hereinafter “GEKA”) provides the statutory warranty for all new GEKA products (hereinafter “Products”).

Where a longer warranty period applies to individual products, this is indicated for the respective product by the icon printed on the product packaging or can be accessed via the printed QR code.

Irrigation controllers: 2-year warranty

PVC water hoses:

WS300: 15-year warranty
WS400: 20-year warranty
WS500: 25-year warranty

The warranty granted is valid from the date of the initial purchase from the retailer in accordance with the following conditions:

 

1. Scope of the warranty

1.1. GEKA guarantees to the end customer, subject to the following conditions, that the product is free from defects in materials and workmanship for the duration of the warranty period.

1.2 Normal wear and tear of parts and components, as well as wear and tear parts and consumables, are excluded from the warranty. This means, for example, for water hoses: GEKA guarantees that the products in the water hose range will remain functional in the sense that they will not burst. The warranty does not cover wear and tear resulting from normal use, such as slight colour changes or abrasion of the print.

 

2. Conditions of the warranty

2.1. The warranty is granted to the end user on the condition that the damage occurs within the warranty period from the date of purchase by the end user.

2.2. Damage of any kind, improper handling, use not in accordance with the intended purpose, or external influences are excluded from the warranty.

2.3 The warranty covers use for the applications listed in the current GEKA catalogue.

2.4. In the event of damage, both the defective product and the original proof of purchase must be submitted to GEKA without delay, but no later than 4 weeks after the damage occurs.

2.5. GEKA must be given the opportunity to inspect the damage. Failure to do so will result in the exclusion of warranty claims

 

3. Scope of the warranty

3.1 GEKA’s liability includes the free replacement of the product in question where damage has occurred that can be demonstrably attributed to manufacturing defects at our production facility.

3.2 Should the product in question no longer be part of the product range at the time of replacement, we shall supply a replacement of at least equivalent value from the current range.

3.3 This warranty does not give rise to any claims beyond the aforementioned right to a replacement, in particular claims for damages of any kind.

3.4. Making a claim under the warranty during the warranty period does not extend the total duration of the warranty.

3.5. Warranty claims against the contractual partner from whom the end user purchased the product in question remain unaffected by this warranty.

 

4. Worldwide Validity, Foreign Trade Law 

4.1 The warranty applies worldwide.

4.2 GEKA shall be released from its warranty obligation if the fulfilment of the warranty would result in a breach of national or international foreign trade regulations or of embargoes and/or other sanctions.

 

5. Returning the product under warranty 

In the event of a warranty claim, please send the affected product, together with a copy of the original proof of purchase and a description of the fault, with sufficient postage to the following service address:

6. Governing law and jurisdiction 

6.1 The warranty is governed by the laws of the Federal Republic of Germany, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

6.2 This choice of law does not result in you, as a consumer, being deprived of the protection afforded to you by those provisions which, under the law of the country in which you have your habitual residence, cannot be derogated from by agreement
